Rosebery Grounds Maintenance

As Rosebery Housing Associations Preferred Procurement Adviser we are thrilled to be assisting them in the procurement of their Grounds Maintenance Contract. Our commission comprises an Open OJEU tender which will be issued in January 2012 following extensive tenant and leaseholder consultant to ensure that the procurement shows best value for leaseholders but is also a sustainable, quality solution for Rosebery and its residents. Legal support will be provided by Trowers & Hamlins.
2012 Charity - St Mungos

Our chosen charity for 2012 is St Mungos. St Mungos has a tremendous impact on the lives of people who are homeless, or could potentially become homeless. We will be supporting them initially via our e-christmas card where we will donate the cost of posting a card to our clients to St Mungos. However, that is just the start of our fundraising efforts of behalf of St Mungos! We are also undertaking the Gold 2012 Challenge.......

Why is it so important that we raise these vital funds for St Mungos? Well, a major part of our work is in housing and indeed Healthcare. We understand the need of getting people into houses, keeping them away from the prospect of homelessness and ensuring they remain healthy. St Mungos performs all of these roles:-
- Housing - last year St Mungo outreach teams helped 526 people off the streets. They provided accommodation for over 1,700 people in a mix of housing projects from emergency shelters to hostels to semi-independent homes for people with complex needs. One innovative new project is The Lodge. They also helped 703 of their residents make positive accommodation moves.
- Health - They supported more than 1,000 clients last year with their mental health and substance use needs. Their LifeWorks A4 4pp April 2011 briefing explains about one ground-breaking psychotherapy service, while they also piloted a Homeless Intermediate Care project in south London.
- Work - St Mungos Skills and Employment team supported 1,0005 people in finding employment, training, further education and in taking up a range of other activities.
The e-cards will be coming out in mid December and we will update on the Gold Challenge very soon.......when our arms and legs stop aching from the initial efforts!
Repairs & Maintenance Charter – Getting the Basics Right

Neil Thody has been on invited onto the Expert Steering Group supported through Chartered Institute of Housing and Mears Group for the development of a new Charter for delivering repairs and maintenance in the social housing sector. The campaign is aimed at "getting the basics right" in delivering repairs and maintenance to tenants. Neil commented "This is a great opportunity to input into how R&M is delivered in the sector and in particular to develop customer focussed services in line with 'outside the sector' services that should enhance the customer experience." Mapeley Estates Ltd

We have been appointed to work with Mapeley Estates Ltd as their procurement adviser in connection with its outsourcing contracts. Initially we will be supporting them deliver two contracts. The first is “Churn and Disposals” which comprises contracts for office relocation services and recycling of office furniture. The second contract is for the installation of Automated Meter Readers (AMRs) to support better monitoring of energy usage, improved billing and reduced administration.
Epping Forest District Council

Following the successful procurement of an “in-sourcing” solution for the Council’s Direct Labour Organisation (DLO), we have been re-engaged to support the Council in the procurement of supplies. The commission will comprise the procurement of a single source supply merchant to the Council with the aim of reducing the cost of material supplies and improving product quality in the delivery of day to day repairs. Legal support is provided by Vertex Law LLP.
Rosebery Gas Servicing

We are delighted to be appointed by Rosebery Housing Association as Procurement Adviser to support them in the re-procurement of M&E contracts. Our commission comprises the development of a procurement strategy involving the “soft market testing” of potential suppliers to ensure that the solutions being delivered are appropriate to the individual needs of Rosebery. Interactive Procurement – A New Approach

Supply Management (August 11) published an article entitled “Breaking With Tradition” (see http://bit.ly/nOL2Xe) where Swiss Bank, UBS adopted an innovative selection process to procure a new M&E partner to fulfil facilities management services across the client’s property portfolio. The first part of the process comprised market engagement prior to procurement including meetings with potential providers as well as peer organisations.
READ MORE...This process enabled UBS to specifically define their requirements and also to engage stakeholders in the process. The next stage of the process would ordinarily comprise a RFP (Request for Proposal) based on explicit tender documentation. In the case of UBS they felt that this was a time and resource intensive process and preferred to adopt a “technical workshop” approach instead, whereby bidders had to facilitate a workshop using the team that would be deployed if successful. In particular they cited the benefits of this approach to selection by observing the organisation skills and non-verbal communication within the team. They also undertook site visits to client organisations to assess the capabilities of the service provider. Shortlisting and a further workshop were undertaken in arriving at the final solution and the outputs of the workshops were then incorporated into the final contract. UBS has benefited from a shorter procurement cycle and a partnership approach, which has enabled both parties to align the organisation cultures from the start and therefore build a sustainable partnership.
Of course, in the public sector, the rules of engagement are slightly different and to a large extent are determined through the Public Contract Regulations (2006). However, some of the key aspects of the approach adopted by UBS can be applied in the public sector and at Cameron Consulting, we have adopted all of the best practice demonstrated by UBS in recent procurement. In highlighting some of the key innovations, we set out below our experience of adopting “Interactive Procurement”:-
Early Supplier Engagement – Understanding the market is critical to the design stage of procurement. It also allows the opportunity to explore wider options that perhaps haven’t been previously considered. In our work with Rosebery Housing Association, we are conducting a “Soft Market Testing” exercise to find out what capabilities there are in the market to deliver the services required by the client. This includes options on “bundling” of works/services and establishing the market attractiveness of this approach. The outputs will contribute greatly to the design and enable us to design solutions that solicit maximum interest and innovation in much the same way that UBS did through their initial cross-functional working group.
Site Visits – The inclusion of site visits, as part of an evaluation process can be particularly helpful in determining capability. UBS found that this process enabled them to assess the strength of the relationship between vendor and supplier. In our work with Catalyst Housing Group we included site visits as part of the evaluation process in the selection of a repairs contractor. To ensure that site visits were used objectively, they were only utilised as part of a validation process to support written proposals. We refer to this as the “Ronseal® Test”, i.e. “It does what it says on the tin”! The site visit therefore focussed on looking at those responses by bidders, in practice to determine whether what they said they did, they actually do. Stakeholders were also engaged in this process.
Interactive Workshops – There is absolutely no substitute for seeing a team in action before you engage them. In much the same way as a football scout will look at the performance of a player before offering them a contract, the opportunity to see a team in action is invaluable, particularly if the team is tasked with a commercial scenario. At Epping Forest District Council we adopted an “Assessment Centre” in the procurement of a “Repairs Management Contractor”. This comprised a presentation, role-play and competency based interview with the team. We engaged professional occupational psychologists to assess behaviours of individuals and the team to learn about the right cultural fit between vendor and supplier. As with UBS we utilised an objective scoring process to ensure that the process was conducted fairly. We also engaged stakeholders as observers in the process, although their own opinions validated the professional assessments being made.
Whilst EU Procurement Rules may seem limiting in terms of process and regulatory compliance, there are opportunities to adopt best practice from the private sector in terms of supplier selection. The key issue in EU Procurement is making the selection process transparent and objective. As clients seek greater innovation it is becoming increasingly apparent that more “Interactive Procurement” is required. It is also more relevant given the increasing number of contract failures caused by low bidding, poor quality client briefing and a general lack of understanding of client requirements. Adopting the above can lead to more successful procurement.

Impact of the updated Public Procurement Rules

The Public Procurement Regulations have been subject to an update which came into force on 1st October 2011. This has an impact from both client and supplier/bidder perspective. Do you know what these changes mean for your business? Here we set out some of the key points and what failure to adhere could mean for you.

Do your tender documents reflect these changes? Have you made sure that there are no new criteria which affect you? OGC disbandment All tender documents need to reflect the new governing bodies. Appeals procedures have changed – do you know where to go? Time limits for 'challenge' The time limits have changed – have you updated your in house processes and procedures to comply? Do you know when you need to advise the client that you are going to challenge a decision that has been made? Standstill Notice The requirement for clients to send standstill notices has changed – but do you fully understand the implications of doing this, or what to do if you haven't complied? Standstill notices still need to be accompanied by information in line with transparency guidance. Are you sure that you are receiving all relevant information in the standstill notices you are served? Automatic Suspension Automatic suspension of a contract (preventing you from entering into a contract with preferred bidder) is now triggered when the client becomes aware that a claim form has been issued in relation to that specific contract. As an aggrieved bidder – would you know who to call in the first place to identify whether or not you had a potential claim? Do you understand what happens when a claim is made? What does this mean if you are the preferred bidder? Core Pre Qualification Questionnaire Move to 5 'core' questions to encourage SME's to apply for OJEU contracts. This is to be issued shortly – how will you ensure your documentation is compliant? How as a bidder will you 'stand out' in a 'core questions' scenario? Do you understand what information the buyer has to provide you with in terms of evaluation criteria and guidance notes? Increasing use of Prior Information Notices (PIN) By undertaking early engagement, competition is known to be enhanced. Would you know how to serve an PIN? Would you use the PIN to undertake a soft market test? Would you use the outcome of soft market testing to shape your procurement strategy? Are you getting involved in soft market testing? Are you reading/answering questions appropriately or trying to throw in standard marketing material? You have a real opportunity to shape procurements by being involved early on – make it count. Increasing Transparency All contracts to be published on Contracts Finder – there are ways to make this process a little easier to comply with – are you using them? Have you registered on Contracts Finder? Are you actively seeking out those 'smaller' contracts which are not published in OJEU? We are offering a ‘Compliance Review’ service. Sometimes you don’t need to have a full procurement carried out for you. However, are you absolutely sure your documents and process would stand up to a challenge by an aggrieved bidder? By having your documentation and process checked, or indeed purchasing a documentation package from us, you not only reduce your exposure, but also benefit from expert support without paying for experts to carry out the task driven aspects of procurement for you. Release of Decent Homes funding and the importance of a procurement strategy

On 17th February 2011, 46 local authority landlords received £1.6bn of ‘decent home backlog funding’ to ensure that they improve their housing stock to the Decent Homes Standard. Clearly, ‘Decent Homes’ is not a new phenomenon, however, there is now an increased pressure to ensure that this money is utilised in the most efficient methods possible. In fact, the press release issued by HCA states ‘a particular emphasis on achieving value for money’. I’m sure that tenants are hoping this brief is met as well. The funding should release funds to refurbish around 150,000 council homes, but it also comes with a promise from the HCA to ‘offer their specialist expertise’ to ensure that the decent homes works are delivered as quickly and cost effectively as possible.
READ MOREThe funds allocated to the 46 landlords varies considerably from £300,000 for South Lakeland to £100,500,000 to Lambeth Council. The spread of the allocation across the 5 year period is also quite staggering with some authorities receiving nothing for the first couple of years. As a consultancy specialising in construction and housing in particular procurement and post contract advice for major works programmes, we understand only too well the importance of planning the ‘how to’ of spending this money wisely to ensure the best outcome.
Understanding the ‘how to’ has a number of intricate facets, but fundamental to all of this should be the production of a clear procurement strategy which sets out key gateways and ‘checkpoints’ for all to ensure that the monies allocated to each authority offer absolute best value for all. The procurement strategy should not only set out the works required but also the preferred contract forms for different works and also who will be involved; role of officers and external consultants; clear guidelines on procurement strategy and documentation; involvement of stakeholders and most importantly the actual timelines and allowances for slippage.
We have been providing assistance in the production of procurement plans for the last 10 years - it is something we have considerable expertise in helping clients understand the importance and need for. We are trusted advisers to a number of authorities who have undergone similar schemes over the last 10 years and while the market has changed, the need for expert advice at key points stays ever strong. 'In-sourcing' Repairs & Maintenance

Following the comprehensive spending review in October 2010 and increasing pressure to reduce budgets, registered social housing landlords (RSLs) are looking at more innovative and cost effective ways to deliver services. In particular, responsive repairs is an area for which social landlords have an ongoing commitment to deliver to their tenants. Traditionally, these services have either been provided by an in-house contracting team (Direct Labour Organisation or DLO) or through an outsourced service provider, most commonly under a construction contract with the RSL. In the case of Housing Associations an outsourced service represents additional costs where VAT cannot be reclaimed. In these circumstances a direct workforce would reduce the VAT expense considerably (mainly in relation to the labour element).
READ MORE...Whilst DLOs have some appeal for the reasons outlined above, they also have other advantages and in particular, their knowledge of the stock and customer, which in many cases results in high levels of customer satisfaction. DLOs do however suffer from a degree of institutional inertia and a distinct lack of commercialism in business practice that so often is provided by a commercial partner. Such lack of commercialism often leading to inefficiencies and a failure to deliver value for money.
So, on the one hand we have a workforce that is largely customer focused but on the other hand, lacks the commercial wherewithal to implement business improvement. Therefore, the benefits of an in-house team combined with the commercial best practice of an external provider, could arguably deliver a first class repairs service?
The answer is “In-sourcing”. In-sourcing pretty much does what it says on the tin! It is the bringing in of relevant expertise into a direct labour organisation and introduces commercial expertise and best practice from the commercial partner’s organisation and transferring these into the DLO. Typically, the in-sourcing partner will be a commercial contracting organisation or similar, who can provide construction management expertise and in addition, such back office functions such as improved IT, procurement and supply chain knowledge. We have referred to this role as a “Repairs Management Contractor (RMC)”.
As with most public sector organisations, an “in-sourcing” solution represents a procurement activity for which EU Rules apply and in particular for the type of service being required, this is classed as ‘Services’ under Schedule 3 of the Public Contract Regulations 2006. Procurement could be under the Restricted or Competitive Dialogue Procedure, although the latter should only really be used in circumstances where the scope of service is not fully defined. In our opinion, with good preparation and consultation, the scope of works can be fully defined and therefore, the Restricted Procedure is perfectly adequate for procurement of this nature.
The eventual appointment of the successful RMC should be on an appropriate Service Level Agreement which sets out clearly the required role of the RMC as well as a description of other key outputs required, which could relate to a number of added value services. Standard contracts would not be appropriate and therefore careful consideration should be given to structuring a contract that aligns most appropriately with the client requirements.
We have recently concluded a procurement exercise to deliver one of the first “In-sourcing” solutions in the country with Epping Forest District Council (EFDC). Tenders were evaluated using a highly innovative evaluation process comprising a “Desktop Evaluation” and an “Assessment Centre” where the candidate was required to participate in a range of exercises to assess suitability.
Cameron Consulting has worked in collaboration with Vertex Law to develop the tender documents, which have a number of innovative features including an incentivisation scheme linked to the overall performance of the DLO.
For EFDC, one of the critical issues was to have a solution that was sustainable in the long term and one that presented low risk to the Council. The in-sourcing solution was perfect in this respect; any potential failure of the RMC would be mitigated by the fact that the front-line staff delivering the service would remain as employees of the Council and therefore service delivery to the customer would not be impacted.

Paul Pledger – Assistant Director of Housing, Epping Forest District CouncilIn addition, an “in-sourcing” solution will invariably involve the placement of personnel into the client organisation (DLO). Therefore the cultural fit between the in-sourcing partner and the client organisation is critical to the long-term sustainability of the arrangement. Accordingly, the selection process should therefore involve selection criteria around getting the right people embedded within the client organisation. To this end, we designed an “Assessment Centre” as part of the selection process to assess bidders and in particular, the individuals to be appointed as the RMC.
Clients who are seeking innovative solutions to delivering responsive repairs should consider “In-sourcing” as a viable alternative to more traditional models. For those who currently operate direct labour organisations but feel that service improvement is challenging and takes too long to implement should consider in-sourcing. Those who currently deliver services via an out-sourced partner should also consider in-sourcing, as part of the establishment of a trading division of the RSL. Indeed, the procurement of an RMC could be the first step in establishing a trading company, using the commercial expertise of the RMC to build a new business.

Made in 'Dagenham'

Watching the film ‘Made in Dagenham’ offered a fascinating insight into how the Equalities Agenda has changed over the years. The premise of the film is that female machinists were not being paid the same wage as a ‘skilled worker’. This led to a fascinating series of events which culminated in a meeting with Barbara Castle to agree what became known as ‘Equal Pay Act’ (1970). Clearly, times have changed and the Equalities Bill (2010) led to a number of other significant changes which reflect how we now work as a society to ensure that everyone is treated equally in the workplace - not just in terms of pay scale!
READ MORE...This particular area of law is a fascinating one with a number of proposed changes this year alone. As a matter of course, all companies should be reviewing their policies at least annually to take into account new legislation, however, the following changes expected this year should be written into policy documents as soon as possible. The key changes expected in the next couple of years are:
Positive action relating to recruitment and promotion
Public sector equality duties
Age discrimination by service providers
The notion of being ‘allowed’ to discriminate based on age (think SAGA holidays!) is again fascinating, but surely all to do with risk based on the nature and types of activity someone may undertake. Obviously, the most important aspect of these changes is the need for people to undertake the necessary checks on current policies and procedures and ensure that moving forward, new legislation is taken into account.
Anti-Bribery Policies

The Bribery Act 2010 was given Royal Assent in April 2010 and should have come into force in the UK in April 2011. The implementation of the Act has been delayed but as yet, no new date of implementation has yet been given. Prior to The Bribery Act (2010), the law relating to bribery was contained in a number of different pieces of legislation, resulting in a rather confusing approach.
For the purposes of this Act, bribery is defined as the giving or taking of a reward in return for acting dishonestly and/or in breach of the law. There are 4 possible offences set out within this act:

- Bribing a foreign public official
- Failure to prevent bribery
The last offence, the ‘corporate offence’ - occurs when an organisation fails to stop people who are operating on its behalf from being involved in bribery. In our opinion, it is the ‘corporate offence’ that organisations need to pay particular attention to. This offence could occur as a result of the activities of a range of people working on behalf of the organisation - an employee, consultant or agent, for example - if those individuals were involved in accepting or receiving a bribe which resulted in the organisation gaining or retaining business. This is a change to the current approach to the law which only sees bribery involving senior managers likely to result in legal action. The new legislation states that if the ‘corporate offence’ is committed, then both the organisation and its Directors could receive unlimited fines. There are however a number of measures you can put in place as an organisation to ensure that you always have the ability to demonstrate that you had put measures in place to prevent bribery. Therefore, the suggestion is that all companies should have an anti-bribery policy which covers at least the following:
- Review of standing orders and signing authorities
- Training of all employees on how to act when bribery is attempted
- Review of Whistleblowing policy to cover the anti-bribery act
- Review of gifts and hospitality procedures
- Listing of acts of bribery as gross misconduct in employment contracts
- Undertaking of risk assessments
- Full anti-bribery policy in place
It is anticipated that anti bribery policies will feature in procurement checks in the very near future and it is therefore worth investigating what steps you as an organisation are going to take to ensure that you have taken every reasonable measure to protect yourself and your organisation.

New Consultant – Heather Langridge
Heather is a London School of Economics graduate in Housing and Social Policy and a Fellow of the Chartered Institute of Housing. With over 20 years of experience in housing management she has an extensive understanding of all aspects of housing practise, from contract and performance management and contingency planning to supplier development and communication. She is able to foster relationships between all parties to achieve the level of performance and quality required by contracts, value for money, continuous improvement and sustained business growth.

Tandridge District Council – Health Check
Tandridge currently provide their repairs and maintenance via their DLO. This contract is being run very successfully, but they had no way of comparing their service levels to that of other similar organizations. We are in the process of carrying out a DLO ‘healthcheck’which will allow Tandridge to benchmark their services in terms of Value for Money and Best Practice. Catalyst Communities Housing Association – Soft Market Testing
CCHA are about to re-procure their repairs and maintenance contracts. We are delighted to be working with them throughout this programme. CCHA are committed to delivering innovative, value for money services to its customers and to ensure that they maintain this ethos throughout the process, we organized a Soft Market Test to allow potential service providers to engage in early discussion with CCHA and its stakeholders to help shape the future procurement strategy. Helping Rykneld Homes achieve Decent Homes
We were appointed by Rykneld Homes in June to assist with their Decent Homes Programme. Our role is very exciting as we are working with a Round 6 ALMO to help them not only achieve their Decent Homes Standard but also working with them while they work to achieve the necessary two stars to finalise the monies they require to complete their works programme. We wish them luck and look forward to a great relationship with them.
Wandsworth Roofing Works
We have been commissioned by Wandsworth to help them procure their roofing partner for works to be undertaken early next year. This is a great compliment to our dedicated team.
New Employee – Sarah Rae
Sarah Rae has joined our administration team helping us keep those all important documents and meeting requests flowing just the way our clients like them. Sarah comes from a corporate banking background and worked in the City of London for several years. Having taken time out to look after her two young children, Sarah decided to return to work closer to home and now joins us working on a part time basis. Sarah will be providing support doing everything from arranging our client meetings to managing our Customer Satisfaction Programme – so expect a call from her sometime soon!
In her spare time, Sarah enjoys socialising with friends as well as playing golf, skiing and spending time with her family.
CHAS accreditation
Having been approved by CHAS since 2006, we decided that it was time to make the big, brave step towards accreditation. We achieved this last month and are delighted that we conform to their standards. For more information on CHAS and their approved contractors, please see www.chas.gov.uk. We shall be applying for their environmental certificate soon as an interim step in our ISO14001 plans.
Anthony Nolan – ‘Brain Gym’ Partner
After much deliberation, we have chosen to work with Anthony Nolan for the year. They will now receive 2.5% of the fee from any Brain Gym Programme that is delivered. This is a big part of our Corporate Social Responsibility commitment and they agreed to work with us as they felt our values were very aligned to theirs. Helping Phoenix Community Homes achieve Decent Homes
Phoenix Community Homes are a newly formed Housing Association. They are unique in that they are the first association to use the Community Gateway approach in London. We are therefore delighted to have been asked to help them with consultant procurement in the first stage of their Decent Homes works programme.
